01

Ownership of Content

You own what you write. When you publish a story, chapter, or any creative work on Novelux, you retain full copyright ownership of that content. Novelux does not claim ownership over your original creative works.

Copyright protection arises automatically the moment your work is written down in a fixed form — no registration is required, though formal registration with your national copyright office provides significant legal advantages, including the ability to sue for statutory damages.

Author's Rights

Under the Berne Convention (adopted in 189 countries), your work is automatically protected internationally the moment it is created and fixed in a tangible medium. You do not need to include a © notice, though doing so is strongly recommended as it deters innocent infringement claims.

What you own
Your original story text, characters, plot, world-building, dialogue, and unique narrative expression.
What isn't protected
Ideas, themes, genres, general concepts, historical facts, and titles are not protected by copyright law.
You can
Publish your work elsewhere simultaneously, remove it from Novelux at any time, and license it to others.
Your moral rights
You retain the right to be credited as the author and to object to distorted uses of your work.
02

License to Novelux

By posting content on Novelux, you grant us a limited, non-exclusive, royalty-free, worldwide license to host, display, distribute, and promote your work on our platform and associated services.

This license is strictly for operating and improving the Novelux platform. It does not grant Novelux the right to sell, sub-license, adapt, or otherwise commercially exploit your work without your explicit written consent.

  • Display: We may show your story to readers on Novelux apps and website.
  • Promotion: We may feature excerpts (up to ~300 words) in promotional materials with attribution to you.
  • Technical operations: We may cache, store, and format your work for delivery across devices.
  • We will never: Sell, publish, or adapt your work in any other format without a separate written agreement signed by you.
  • We will never: Train AI models on your work without your explicit opt-in consent.

This license terminates automatically when you delete your work from Novelux, subject to a reasonable technical wind-down period of up to 30 days for cached copies.

03

Prohibited Content & Infringement

You may only publish content you have the legal right to share. The following are strictly prohibited on Novelux:

  • Plagiarism: Copying another author's story, in whole or in part, and presenting it as your own work.
  • Pirated published works: Uploading commercially published books, scripts, or lyrics that you do not own the rights to.
  • Unauthorized adaptations: Translating, continuing, or rewriting another author's original work without their explicit written permission.
  • Song lyrics: Embedding song lyrics without a license from the rights holder, regardless of attribution.
  • Screenplay reproduction: Rewriting or closely reproducing dialogue and events from movies, TV shows, or video games.
  • Facilitating piracy: Sharing links to pirated PDFs, requesting illegal downloads, or distributing free access to paywalled works.
Note on Giving Credit

Credit and attribution do not grant you the right to use another person's copyrighted work. Even if you name the original author, reproducing their content without permission is still infringement.

04

DMCA Takedown Notices

Novelux complies with the Digital Millennium Copyright Act (DMCA) and applies this policy globally. If you believe your copyrighted work has been reproduced on Novelux without authorization, you may submit a formal takedown notice.

A valid DMCA notice must include all of the following:

1
Identification of the copyrighted work
Describe the original work claimed to have been infringed. Include title, author name, ISBN/ASIN if applicable, or a link to where the original can be viewed.
2
Identification of the infringing content
Provide the specific URL(s) on Novelux where the infringing material is located. General descriptions are not sufficient.
3
Your contact information
Include your full legal name, mailing address, telephone number, and email address.
4
Good faith statement
A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
5
Accuracy statement & signature
A statement, under penalty of perjury, that the information is accurate and that you are the copyright owner or authorized to act on their behalf. Include your electronic or physical signature.
Important Warning

Submitting a false or misleading DMCA notice exposes you to legal liability, including damages. Only the actual copyright owner or their legally authorized representative may submit a takedown notice.

Upon receiving a valid notice, Novelux will promptly remove or disable access to the allegedly infringing content. We aim to process valid notices within 2–5 business days.

05

Counter-Notices

If your content has been removed due to a DMCA notice and you believe the removal was in error — for example, because you are the legitimate rights holder or the use constitutes fair use — you may submit a counter-notice.

A valid counter-notice must include:

  • Your full legal name, address, phone number, and email.
  • Identification of the content that was removed and its original location on Novelux.
  • A statement under penalty of perjury that you have a good faith belief the content was removed by mistake or misidentification.
  • A statement consenting to jurisdiction of the federal court in your district and acceptance of service of process from the original complainant.
  • Your physical or electronic signature.

Upon receiving a valid counter-notice, we will forward it to the original complainant. If the complainant does not file a court action within 10–14 business days, we may restore the content at our discretion.

06

Repeat Infringers

Novelux has a strict repeat infringer policy. Accounts that accumulate multiple confirmed copyright violations will face escalating consequences:

1st Violation — Warning & removal 2nd Violation — Temporary suspension 3rd Violation — Permanent ban

Violations are linked to the account holder, not individual stories. In cases of egregious or deliberate infringement, Novelux reserves the right to permanently terminate an account upon the first confirmed violation without prior warning.

07

AI-Generated Content

As of 2025, the legal landscape around AI and copyright is rapidly evolving. Novelux's current policy on AI-generated content is as follows:

  • AI-assisted writing is permitted where a human author provides substantial creative direction, editing, and original expression. The human must be the primary creative force.
  • Fully AI-generated stories with no substantial human creative input are not eligible for copyright protection under current U.S. Copyright Office guidance and may not be monetized on Novelux.
  • Using AI to reproduce copyrighted works — prompting AI tools to reproduce or closely paraphrase existing stories — is prohibited and constitutes infringement.
  • Disclosure recommended: We encourage authors to disclose significant AI assistance to their readers. We may require disclosure in future policy updates.
2025 Legal Context

The landmark Bartz v. Anthropic ruling (2025) established that AI training on legally acquired works may constitute fair use, but training on pirated copies does not. Only works with formal copyright registration qualified for compensation. We strongly encourage authors to register their works.

08

Fan Fiction & Derivative Works

Fan fiction occupies a legally complex space. Novelux permits fan fiction under the following conditions:

  • Non-commercial fan fiction that uses established fictional characters and worlds in new, transformative stories is generally permitted.
  • Original fan fiction content — the unique plot, dialogue, and narrative you create — belongs to you and may be protected by copyright even within a fan fiction context.
  • Direct reproduction of copyrighted source material — transcribing scenes, rewriting events with minor changes, or copying dialogue — is not permitted.
  • Changing only names or genders of characters from an existing story does not constitute original work. This is still infringement of the source author's work.
  • Rights holders may object: Even compliant fan fiction can be removed if the original copyright holder submits a valid DMCA notice.
09

How Novelux Protects Your Work

We take proactive steps to protect authors on our platform:

Scraping Detection
We monitor for external sites that illegally copy Novelux content and issue takedown notices on authors' behalf when authorized.
DMCA Agent
You may authorize Novelux to act as your DMCA agent to submit takedown notices to third-party platforms on your behalf.
Reporting Tools
Every story has a built-in "Report" function. Selecting "Copyright Infringement" routes the report directly to our Trust & Safety team.
No AI Training
Novelux does not use author content to train AI models without explicit, informed, opt-in consent from the author.

We strongly recommend all authors keep backup copies of their work outside of Novelux. In the event of an account closure, we are unable to restore or transfer story content.
